TERMS OF SERVICE

WELCOME TO PEAK.

Thanks for choosing PEAK, a social network platform. These Terms of Service (“Terms” or “Agreement”) govern your access to and use of the PEAK services, including PEAK.VN and any other domains, websites, applications (including mobile apps), products, services, and content provided by [PEAK PLATFORM LEGAL NAME] (“PEAK,” “we,” “us,” or “our”) (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Community Guidelines and Privacy Policy (collectively, the “Policies”). If you do not agree, do not use the Services.

 

IMPORTANT NOTES

×       Personalization & Ads. Some Services are personalized and may involve processing information about you and your activity to provide personalized content and advertising as described in our Privacy Policy.

×       Language. These Terms are written in English. Translations are provided for convenience only. If there is any conflict, the English version controls.

×       Liability Limits. Sections 15–17 include important limitations of liability and disclaimers.

 

1. ACCEPTANCE OF TERMS

1.1 Binding Agreement. You may use the Services only if you can form a legally binding contract with PEAK and are not prohibited from using the Services under applicable law.
1.2 Policies. You agree to comply with these Terms and our Policies, which are incorporated by reference.

1.3 Additional Terms. Certain features (e.g., paid services, tipping, developer APIs) may have additional terms. If those terms conflict with these Terms, the additional terms control for that feature.

 

2. CHANGES TO THESE TERMS

2.1 Updates. We may update these Terms or Policies from time to time. We will post the updated version on the Services and may notify you via email or in-product notice.
2.2 Effective Date. Unless required otherwise by law, updates take effect 14 days after posting. If we require your explicit consent, the updated Terms take effect when you consent.
2.3 If You Disagree. If you do not agree to updated Terms, you must stop using the Services.
2.4 Prior Versions. We may maintain an archive of prior versions for reference.

 

3. ELIGIBILITY AND AGE REQUIREMENTS

3.1 Minimum Age.

×       13+ for general users;

×       16+ for users in the EU/UK;

×       18+ to use any Tipping or other monetization features that involve sending/receiving funds.

3.2 Guardians. If you are under the age of majority in your jurisdiction but meet the minimum age, you represent you have permission from a parent/guardian where required by law.

 

4. ACCOUNT REGISTRATION AND SECURITY

4.1 Account Creation. To access certain features, you must create an account with accurate information, including a valid email, age confirmation, password, and a PEAK username.
4.2 Username & URL. Your username may be part of your default profile/blog URL, for example: https://peak.vn/[username]. Usernames/URLs must be unique and may be reclaimed for inactivity or policy reasons where permitted by law.
4.3 Security. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorized access.

 

5. USING THE SERVICES

5.1 Service Changes. The Services evolve. We may modify, suspend, or discontinue any part of the Services at any time, including imposing limits on features or access, and may terminate or suspend accounts as described in Section 18.
5.2 Prohibited Conduct. You agree not to:

×       access non-public areas or systems without authorization;

×       test, scan, or breach our security measures;

×       access the Services except through our official interfaces;

×       scrape, harvest, or collect content or data without permission;

×       send misleading information, forge headers, or disguise the origin of content;

×       interfere with, disrupt, overload, or harm the Services or other users.
5.3 Recommendations. Information about how feeds and recommendations may work can be found in our Help Center (where available).
5.4 Feedback. If you provide suggestions, you grant PEAK the right to use them without restriction or compensation.

 

6. PRIVACY

Our Privacy Policy explains how we collect, use, share, and process information. By using the Services, you acknowledge you have read and understood our Privacy Policy, including any cross-border data transfers where applicable.

 

7. CONTENT AND USER CONTENT

7.1 Definitions.

×       Content” means any content available through the Services (text, images, audio, video, links, code, etc.).

×       User Content” means Content you submit, post, or display through the Services.

×       Public Content” means User Content shared publicly; “Private Content” means content shared with limited visibility settings.

7.2 Your Ownership. You retain ownership of your User Content and the intellectual property rights you have in it. Any revenue you earn from your creations (outside PEAK’s fees) is yours.

7.3 License to PEAK (Required to Operate). You grant PEAK a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, distribute, display, perform, publish, translate, adapt, modify, and create derivative works of your User Content only as necessary to operate, provide, maintain, promote, and improve the Services, and to develop new features.

×  This includes making Public Content available to third parties (e.g., search indexing, syndication, analytics) consistent with your settings and the Services’ functionality.

×       Where required by law, PEAK will obtain your consent for certain processing or uses.

7.4 Duration of License and Deletion.

×       The license continues while your User Content remains on the Services.

×       If you delete specific User Content, we will take reasonable steps to remove it from public view and stop using it for ongoing display, except: (a) copies retained for technical reasons (backup, caching, security logs) for a limited period; and (b) content that others have lawfully shared, reposted, or quoted, which may remain as part of their content and the social record.

×       If you delete your account, we will process deletion as described above and in our Privacy Policy.

7.5 License to Other Users. The Services may allow others to view, share, repost/reblog, or interact with your content based on your settings and the platform’s features. You grant users a limited license to access and use your Public Content through those features.

7.6 Your Responsibilities and Permissions. You represent and warrant that:

×       you have the rights necessary to post the User Content;

×       your User Content and behavior comply with these Terms, the Policies, and applicable law;

×       your User Content does not infringe or violate the rights of others.

7.7 Affiliate Links. If the Services include affiliate linking, PEAK may add or replace affiliate parameters on eligible links unless you have already included your own affiliate parameters or you opt out (if offered). We will describe opt-out and disclosure details in the Help Center or settings.

 

8. APPLICATION DEVELOPMENT (APIs)

If you build tools or services that access PEAK’s APIs or data, you must comply with the PEAK Developer/API Terms and any documentation, including rate limits and data use restrictions.

 

9. TRADEMARKS

PEAK’s name, logos, and brand assets are PEAK trademarks. You may not use them without our written permission except as allowed by brand guidelines or applicable law.

 

10. THEMES

PEAK may provide HTML/CSS template code for customizing profiles/blogs (“Themes”). Some Themes may be paid (“Premium Themes”) and non-transferable. You may customize Themes for personal use on PEAK. You may not redistribute Themes outside PEAK without permission. If you publish a Theme to the community, other users may continue using it even if you later remove it.

 

11. PAID SERVICES

11.1 Fees. Some features are paid (“Paid Services”). Prices, taxes, and fees are shown at checkout.
11.2 License, Not Sale. Paid Services are licensed, not sold. Unless expressly permitted, you may not transfer, resell, or redistribute Paid Services.

11.3 Changes. We may change or discontinue Paid Services. If you have an active subscription, changes will apply at renewal unless required sooner for legal/security reasons.
11.4 Refunds. Payments are generally non-refundable except where required by law or explicitly stated in the applicable service terms.

 

12. SUBSCRIPTIONS AND RECURRING BILLING

12.1 Auto-Renewal. Subscriptions renew automatically monthly or yearly unless canceled.
12.2 Authorization. You authorize us (and our payment processors) to charge your payment method at each billing cycle.

12.3 Cancel. You can cancel anytime in account settings. Cancellation takes effect at the end of the current billing period unless otherwise stated.

12.4 App Stores. If you subscribe via Apple/Google or another marketplace, you must manage cancellations through that platform.

 

13. COMMUNITY GUIDELINES AND ENFORCEMENT

13.1 Rules. You must follow our Community Guidelines (prohibited content, harassment, illegal content, spam, impersonation, etc.).

13.2 Moderation. We may remove content, reduce distribution, restrict features, or suspend/terminate accounts for violations, repeated offenses, or risk to the community or Services.
13.3 Reports. Users may report content or accounts.

13.4 Appeals. Where available, you may appeal certain enforcement decisions through our in-product process.

 

14. TIPPING FEATURE (IF AVAILABLE)

14.1 Overview. The Services may allow users (“Tippers”) to send tips to creators (“Tippees”).
14.2 No Guaranteed Outcomes. Tips are voluntary and do not create any obligation for Tippees to provide anything in return. Disputes are between users; PEAK does not mediate.
14.3 Eligibility. Tippees must be 18+, reside in an eligible country, and connect an approved payment account (“Connected Account”), which may require identity verification and agreement to the payment processor’s terms (e.g., Stripe).
14.4 Fees and Holds. Tips may be subject to processing fees, platform fees, taxes, chargebacks, refunds, and risk holds as described in the fee breakdown and payout terms.
14.5 Compliance. You agree not to use tipping for scams, fraud, or prohibited content. You are responsible for applicable taxes.

 

15. DISCLAIMER OF WARRANTIES

THE SERVICES AND CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED, SECURE, OR ERROR-FREE OPERATION, OR THAT DEFECTS WILL BE CORRECTED.

 

16. LIMITATION ON CLAIMS; RELEASE

16.1 Time Limit. You must bring any claim related to the Services within one (1) year of the event giving rise to the claim, unless prohibited by law.

16.2 Release. To the extent permitted by law, you release PEAK and its affiliates from claims arising out of: (a) disputes between users; (b) third-party services; (c) unauthorized account use; (d) interception or alteration of communications; and (e) user-organized events/meetups not controlled by PEAK.

 

17. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEAK WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. IN NO EVENT WILL PEAK’S AGGREGATE LIABILITY EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID PEAK FOR PAID SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

 

18. JURISDICTIONAL VARIATIONS

Some jurisdictions do not allow certain disclaimers or limitations. In such cases, these Terms apply to the maximum extent permitted by law, and your statutory rights remain unaffected.

 

19. TERMINATION

19.1 By You. You may stop using the Services and delete your account at any time.
19.2 By PEAK. We may suspend or terminate access if you violate these Terms/Policies or if required for safety, security, or legal reasons.

19.3 Survival. Sections that by their nature should survive termination will survive (including Sections 7, 15–18, 20–21).

 

20. GOVERNING LAW AND DISPUTE RESOLUTION

20.1 Governing Law. These Terms are governed by the laws of [JURISDICTION/COUNTRY], excluding conflict-of-law rules, unless your local consumer law requires otherwise.
20.2 Venue. Disputes will be brought in the courts of [CITY, COUNTRY] unless applicable law requires a different venue.

21. MISCELLANEOUS

·        Entire Agreement. These Terms and Policies are the entire agreement between you and PEAK regarding the Services.

·        Severability. If any provision is unenforceable, the rest remains in effect.

·        Assignment. You may not assign these Terms without consent; PEAK may assign them as part of a merger, acquisition, or asset transfer.

·        No Partnership. No agency, partnership, or employment relationship is created.

·        Notices. Legal notices must be sent to: [LEGAL NAME + ADDRESS + EMAIL].

 

22. COPYRIGHT POLICY (DMCA AND EQUIVALENT)

PEAK responds to valid copyright notices, including under the DMCA where applicable. To submit a notice, include: identification of the copyrighted work; the allegedly infringing material and its location; your contact info; a good-faith statement; a statement under penalty of perjury; and your physical/electronic signature.

Send notices to: [DMCA/COPYRIGHT AGENT NAME + EMAIL + ADDRESS]. We may forward notices to the user who posted the content and may terminate repeat infringers where appropriate.
